General Information
A notary public is a public official who witnesses the signing of important documents to lend legal credibility and a more “official” designation. Notaries are appointed by the state government, typically by the secretary of state, to serve as an impartial witness when performing legal formalities relating to the drafting or certifying of contracts, deeds, and other official documents. The most common function of a notary is to prevent fraud by attesting that a person actually signed a document.
Documents are notarized to deter fraud and ensure proper execution. The notary public is responsible for ensuring that the signers have appeared before them and have produced proper identification. The notary also officiates at the signing and ensures the documents are signed correctly.
A notary can legally notarize documents from any state as long as they act within the boundaries of their jurisdiction and follow all local state requirements. The notarial act must occur in the state where the notary was commissioned. It doesn’t matter where the documents will be recorded as long as the notary is following the Notary laws for the state in which the notary was commissioned.
